Screwing with the rhythms is great for songs. Some of the masters of this are Doug Pinnick of King's X, Creed (even though the guitar player writes the riffs, the rhythms still rule), Dream Theater, and a lot of progressive players. As for copyright protection...that's a good question. I'd imagine you can, as long as it's not just like 3 or 4 notes in a row repeating.
